SHANGHAI police, with the help of community residents, tracked down a father who allegedly abandoned his infant baby in the rain following a family dispute yesterday morning, and then gave the eight-month-old girl back to him.

Zhabei District police would not discuss the case or provide information about the father, but said they told the migrant man not to abandon the baby again.

Police wouldn't say if they will take any legal action against the man.

Yao Haidong, a resident of Guangsheng Garden on Lingshi Road, said he first noticed a man about 30 years old at 9:10am yesterday when he was taking laundry in from his balcony.

"It was drizzling and the man holding a baby in his arms was standing on the lawn in the garden," he recalled.

Yao retreated to his room, but minutes later he heard the baby crying.

"The man has left and the infant was lying on the grass without any shelter," Yao said.

Several nearby residents gathered at the girl's cries and took her to a maintenance room in the building. They called in the police and one of the residents said he knew where the father lived.

Officers immediately located the man and returned the infant baby to him.
The man reportedly told police he attempted to desert the girl and then kill himself after quarrel with his wife.

According to a local newspaper, the mother had returned home by noon and the neighborhood committee was dealing with the matter.

Legal experts said the father could face fines and a maximum of five years in prison if he was found guilty of abandoning the infant baby.

"Police did not give him any punishment because there was no serious consequence," said lawyer Liu Chunquan.

His words were echoed by Zhang Youde, a sociologist at Shanghai University.

Zhang said the juvenile interests protection system in China, just like the country itself, is in the process of developing.

"As the father did not cause a very bad social effect, it was wise for police not to carry on further investigation," Zhang said. "Otherwise the cost of law enforcement would be very high, which might not be the best way to use limited police resources."

He said parents who abandon children must be educated before they regain custody of the child, however, to ensure they don't abandon the child again.
