China's IP protection: not perfect but in progress

China’s Intellectual Property Protection in Progress

 

    On Sept 7th, 2004, Tuesday, the Shanghai- Kansai Economy Seminar was held in Garden Hotel. Vice –Mayor Zhou Yupeng, Deputy Mayor of Osaka Mr. Masashi Igoshi and other official of both sides attended the seminar.

    The Japanese side raised questions concerning the reform of state-owned enterprises that the Municipal Government encourages the Japanese Enterprises to join in. A Japanese patent attorney criticized China’s IP protection saying that the patent application descriptions were always too short, etc. In response, Mr. Spring Liu, an IP lawyer with Guangsheng & Partners Shanghai Office, delivered a short speech introducing the overall situation of IP protection in China.

  In 2003, the IP cases that the people’s Court received all over the country has increased nearly 19 %, almost double the 9% GDP increase. This does not only reflect the improvement of IP protection awareness of the society but also proves the success of the amendment of the IP laws in accordance with TRIPS after China joining the WTO. Many foreigners are not clear about the great changes of the laws of China, some foreigners do not even believe there is IP protection in China, which often leads to misunderstanding and even criticisms. As the IP protection laws have been built up for 20 years, there is still a lot to improve including training skillful patent agents and patent lawyers, etc. However, the international community should also be aware that China’s current laws about domain name disputes and IP protection in internet are very prompt and even advanced in the world. Due to difference in culture and languages, foreigners may have difficulty in understanding Chinese laws’ conformity with the world’s usual practice, For example, in Chinese laws there is no such term as “injunction”, but there is a way of bearing civil liability so called “ cease the tort”(word for word translation) which is actually the same legal effect as  “injunction”. Sometimes it is hard for foreigners to understand these subtle differences.

  The IP protection in China is not perfect but it is in progress. According to Mr. Liu, it is in contrary to the spirit of rule of law if foreign enterprises gave pressure to the Chinese government instead of hiring good local lawyers to take proper measures to protect their IP rights.
